Terms of Service
Welcome to muze. These Terms of Service ("Terms") are a legal agreement between you and Muze Rentals LLC, a Minnesota limited liability company ("muze," "we," "us," or "our"). They govern your use of the muze app, website, and services (together, the "Service"). By creating an account or using the Service, you agree to these Terms. If you don't agree, please don't use muze.
1. Who can use muze
To use muze, you must:
- Be at least 17 years old. If you are under 18, you may only use muze with the involvement of a parent or legal guardian who agrees to these Terms on your behalf and takes responsibility for your activity.
- Be a currently enrolled student with a valid school email address ending in .edu, which we use to verify you and place you on your campus.
- Provide accurate account information, keep one account, and keep your login secure. You're responsible for everything that happens under your account.
2. What muze is (and isn't)
muze is a marketplace that helps students on the same campus rent clothing and accessories to and from one another. muze is a platform, not a party to any rental. We do not own, hold, inspect, clean, or deliver the items listed. A rental is an agreement directly between the person listing the item (the "lender") and the person renting it (the "renter"). muze is not a rental company, a consignment store, or an insurer, and does not guarantee any item or any user's conduct.
3. Listing an item (lenders)
- You must own the item or have the right to rent it out.
- Your title, photos, size, brand, and condition must be accurate and your own (or ones you have the right to use).
- You set your payout, and the renter-facing price is your payout plus muze's service fee.
- You're responsible for the item being clean, safe, and as described at handoff.
- You may not list counterfeit, stolen, unsafe, or illegal items, or anything that isn't a genuine clothing or accessory rental.
4. Renting an item (renters)
- Rentals run for the weekend window shown in the app. You arrange an in-person handoff with the lender to pick up and return the item on your campus.
- Treat the item with care and return it on time in the condition you received it, aside from normal wear.
- While an item is in your possession, you are responsible for loss or for damage beyond normal wear.
5. Handoffs, returns, damage, and loss
Handoffs and returns happen in person and are arranged between the lender and renter. Because muze isn't a party to the rental, disputes about condition, lateness, damage, or loss are primarily between the two of you. muze may, at its discretion, help mediate or make a decision to keep the community fair, but we are not obligated to and are not responsible for any item or any interaction between users. Please meet in a safe, public campus location.
If a piece is not returned, or comes back damaged beyond normal wear, you authorize muze to charge the payment method used at checkout for the reasonable repair or replacement cost of the piece, after we review the case with both students. We will always try to resolve it in chat first.
6. Payments and fees
- Payments are processed by our payment provider, Stripe. muze does not store your full card details.
- The price a renter sees includes muze's service fee (roughly 20%), which is how muze operates. The lender receives their set payout for a completed rental.
- muze does not charge a security deposit.
- You authorize muze and Stripe to charge your payment method for the amounts shown. You're responsible for any applicable taxes.
7. Cancellations and refunds
Before handoff: a renter may cancel their request, and a lender may decline or cancel a rental, at any time before the item is handed off. When that happens, the renter automatically receives a full refund of everything they paid, back to their original payment method. Refunds are issued right away and usually appear on a card statement within 5 to 10 business days, depending on the bank.
After handoff: once the item has been picked up, the rental is final and non-refundable, except at the lender's discretion or where the law requires otherwise. Damage and loss are handled under Section 5. In cases of a dispute, a no-show, or a clear violation of these Terms, muze may issue, withhold, or reverse payments, including partial refunds, at its reasonable discretion.
8. Reviews and your content
You may review the people you rent from and to. Reviews and any content you post must be honest, your own, and free of abusive, false, or unlawful material. You keep ownership of your photos and content, and you grant muze a non-exclusive license to host, display, and use them to operate and promote the Service. You're responsible for the content you post.
9. Things you agree not to do
- Commit fraud, misrepresent items, or take payments or deposits off-platform to avoid muze's fees.
- Harass, threaten, discriminate against, or endanger anyone.
- List prohibited, counterfeit, unsafe, or illegal items.
- Impersonate anyone, create multiple or fake accounts, or misuse another student's identity.
- Scrape, hack, or interfere with the Service or attempt to bypass its security or verification.
10. Moderation, suspension, and termination
To keep muze safe, we may remove any listing or content, and suspend or terminate any account, at our discretion, including for violating these Terms, for suspected fraud, for safety reasons, or for conduct we believe harms the community, with or without notice. You may stop using muze and delete your account at any time.
11. Disclaimers
The Service and all items are provided "as is" and "as available." To the fullest extent permitted by law, muze disclaims all warranties, and does not guarantee the quality, authenticity, safety, fit, cleanliness, or availability of any item, or the identity or conduct of any user. You use muze and rent items at your own risk.
12. Limitation of liability
To the fullest extent permitted by law, muze and its owners will not be liable for any indirect, incidental, special, or consequential damages, or for lost items, lost profits, or injury, arising from your use of the Service or any rental. muze's total liability for any claim will not exceed the greater of the total fees you paid muze in the six months before the claim, or $100.
13. Indemnification
You agree to indemnify and hold harmless Muze Rentals LLC and its owners from any claims, damages, or costs (including reasonable legal fees) arising from your use of the Service, your items, your interactions with other users, or your violation of these Terms or the law.
14. Governing law and disputes
These Terms are governed by the laws of the State of Minnesota, without regard to its conflict-of-laws rules. You agree that any dispute that isn't resolved informally will be handled in the state or federal courts located in Minnesota, and you consent to their jurisdiction. Please contact us first, we'd rather sort it out directly.
15. Changes to these Terms
We may update these Terms from time to time. When we do, we'll change the "Last updated" date above, and your continued use of muze means you accept the updated Terms.
